1. General Provisions
These terms and conditions define the rules for making purchases in the online store operated at www.fenek.studio.
The owner and operator of the store is Fenek Studio Agata Klimkowska, Tax ID: 5242637241, Aleja Zjednoczenia 50/16 01-801 Warsaw, Mazowieckie, correspondence address: Tamka 45B 00-355 Warsaw
These terms and conditions are binding for the Seller and all Customers placing orders and making purchases in the online store.
2. Definitions
Terms and Conditions – this document defining the rules of purchase.
Store – online store available at www.fenek.studio.
Seller – Fenek Studio Agata Klimkowska, Tax ID 5242637241, Aleja Zjednoczenia 50/16 01-801 Warsaw, Mazowieckie, correspondence address: Tamka 45B 00-355 Warsaw
Customer – a natural person, legal entity, or organizational unit without legal personality that makes purchases in the Store.
Product – artistic functional ceramics, custom-made, created by Agata Klimkowska and Tosia Kiliś.
Legal provisions – in particular the Civil Code, the Consumer Rights Act of May 30, 2014, the Personal Data Protection Act.
3. Product Information
All Products offered in the Store are new and handmade.
Products are unique in nature – differences between individual pieces of the same pattern are acceptable.
Photos and visualizations are for illustrative purposes and may not reflect the actual size of the Products.
Products should be used only in accordance with their intended purpose, with caution due to their delicate nature.
4. Prices
All Product prices are given in Polish zloty (PLN).
Prices do not include shipping costs, unless stated otherwise in the Product description.
The binding price is the price indicated for the Product at the time of placing the order.
5. Placing Orders
The Customer can place an order through the Store’s website.
A condition for order fulfillment is the correct provision of data necessary for delivery.
Placing an order means concluding a sales contract between the Customer and the Seller.
6. Payments
The Store offers the following payment methods:
electronic payments through the PayU system,
online card payment (Visa, Mastercard),
mobile payment BLIK,
bank transfer (if the option is available).
Payment is considered made when funds are credited to the Seller’s account or payment is confirmed by the PayU operator.
7. Delivery
Delivery is carried out within Poland through courier companies or Polish Post.
Delivery costs are indicated when placing the order.
Delivery time is usually 3–7 business days, unless stated otherwise in the Product description.
8. Right of Withdrawal from Contract
A Customer who is a consumer has the right to withdraw from a distance contract without giving reasons within 14 days from the day of receiving the Product.
To exercise the right of withdrawal, the Customer should send the Seller an appropriate statement (by email or letter).
The Customer is obliged to return the Product in unchanged condition within 14 days from the day of withdrawal from the contract.
Return costs are borne by the Customer.
The Seller will refund the payment within 14 days from the day of receiving the statement, using the same payment method used by the Customer (unless the Customer expressly agrees to another method).
9. Complaints and Warranty
The Seller undertakes to deliver a defect-free Product to the Customer.
The Customer has the right to file a complaint about the Product within 2 years from the date of purchase, in accordance with the provisions of the Civil Code.
The complaint should include a description of the defect and the Customer’s demand.
Complaints should be submitted in writing or by email to the Seller’s address.
The Seller will consider the complaint within 14 days.
10. Personal Data Protection
The administrator of the Customer’s personal data is the Seller.
Personal data is processed for the purpose of order fulfillment and Customer service.
The Customer has the right to access the content of their data and to correct it.
11. Final Provisions
In matters not regulated by these Terms and Conditions, Polish law applies.
Disputes arising from the application of the Terms and Conditions will be considered by the court with jurisdiction over the Seller’s registered office, unless legal provisions state otherwise.
The Terms and Conditions are effective from the date of publication on the Store’s website.
